What is the Difference Between Patent and Utility Models?
The purpose of the Decree-Law on patents and trademarks today is to ensure the protection of all trademarks registered in accordance with the provisions of the Decree-Law. These rights and protections are carried out by trademark attorneys and consulting law firms. The Decree-Law also covers all the principles, rules, and conditions for the protection of trademarks. In its decisions dated different dates, the Court of Cassation has stated that it is necessary to correctly determine whether trademarks are being used in the classes in which they are registered. According to the Intellectual and Industrial Property legislation, an invention is protected in two ways. Firstly, it is protected by utility model certificates, and secondly, by patent certificates. In these areas, trademark attorneys provide the necessary services and information to individuals. Furthermore, for an invention to be protected by utility model registration certificates, the conditions of absolute novelty and industrial applicability must be met. In the patent certificate, in addition to these, the criterion of inventive step must also be met.
